Please read carefully. Using Fleet means you accept these terms.
Agreement
These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and mobility services operated by Fleet ("Fleet," "we," "us," or "our") in the Republic of Ghana, including electric scooter rentals, car and coach rentals, package delivery booking, and related features (collectively, the "Services"). By creating an account, making a booking, unlocking a vehicle, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Who We Are and What These Terms Cover
Fleet provides short-term access to scooters, passenger cars, and related mobility products in Ghana. These Terms form a binding agreement between you and Fleet under the laws of Ghana, including the Contracts Act, 1960 (Act 25) and the Electronic Transactions Act, 2008 (Act 772), which recognise agreements concluded wholly or partly by electronic means.
Additional product-specific rules, fare schedules, insurance summaries, damage policies, and in-app prompts may apply to a booking. If those rules conflict with these Terms on a specific rental, the more specific rules for that booking control for that conflict only.
Eligibility and Age Restrictions
You must meet all of the following to use the Services:
- Be at least 18 years of age to create an account or use any Fleet Service. Our Services are not directed to persons under 18, consistent with Ghanaian capacity rules and Section 34 of the Road Traffic Act, 2004 (Act 683) regarding electrically assisted pedal cycles.
- Scooters and light electric micromobility: You must be at least 18 years old. You must be physically able to operate the scooter safely and must not allow any person under 18 to ride, unlock, or control a Fleet scooter. Knowingly permitting an underage rider is prohibited and may be an offence under Act 683.
- Car and passenger vehicle rentals: You must be at least 21 years old and hold a valid driving licence of the correct class (see Licences). Drivers aged 21 to 24 may be subject to a young-driver surcharge or additional deposit, disclosed before you confirm the booking.
- Coach / larger passenger vehicles: Where the vehicle requires a higher DVLA licence class, you must meet both the statutory minimum age for that class and any higher age Fleet sets for that product, shown at booking.
- Have legal capacity to enter a binding contract under Ghanaian law.
We may refuse, suspend, or terminate access if we reasonably believe you do not meet these requirements or have misrepresented your age, identity, or licence status.
Driving Licences and Identity
Ghanaian licence holders
- For cars and light passenger vehicles, hold a valid DVLA Class B (or higher applicable) licence that is current and not suspended or cancelled.
- For motorcycles, motor tricycles, or products requiring a motorcycle licence, hold a valid DVLA Class A licence (or such other class as DVLA requires).
- Carry your original physical or officially recognised digital licence while operating the vehicle.
Foreign visitors and residents
- Short-term visitors may rent with a valid foreign driving licence of the correct category, preferably with an International Driving Permit (IDP), for the period Ghanaian law permits driving on a foreign licence (commonly up to 12 months from first entry, subject to DVLA rules then in force).
- If you are resident in Ghana beyond that period, present a Ghanaian DVLA licence obtained or exchanged through DVLA before renting.
- Licences must be in English or accompanied by an official translation or IDP. Provisional, learner, or heavily restricted licences are not accepted for unsupervised rentals.
Verification
We may require government-issued photo ID (Ghana Card or passport), your driving licence, proof of entry/residence status, a selfie or in-person check, and payment authorisation. You authorise verification with DVLA or third-party partners where available. Providing false, expired, or another person's documents may lead to immediate termination, deposit consequences where permitted by law, and reporting to authorities.
Account Registration
Provide accurate, complete information and keep it updated. You are responsible for safeguarding login credentials and for activity under your account. Notify us promptly of unauthorised use. Do not share your account so another person can unlock or operate a Fleet vehicle in your name.
Scooter Rentals
Permitted use
Fleet scooters are for personal, lawful transport within designated service areas in the App. One rider per scooter unless the vehicle is expressly designed and labelled for more. Standing kick scooters and similar devices must be ridden only by the account holder who unlocked them.
Safety rules
- Follow all road traffic laws, signals, and instructions from police or authorised officers.
- Where the device is a motorcycle or otherwise subject to Regulation 84 of the Road Traffic Regulations, 2012 (L.I. 2180) and amending instruments, you and any permitted passenger must wear a certified protective helmet meeting Ghana's approved standards (including full-face requirements where mandated).
- For light electric scooters, Fleet strongly requires an approved helmet. Where we provide or require a helmet, wear it correctly for the entire trip.
- Do not ride under the influence of alcohol, drugs, or any impairing substance, contrary to the Road Traffic Act, 2004 (Act 683) as amended (including the Road Traffic Amendment Act, 2025 / Act 1153 and related BAC limits).
- Do not use a phone in a way that distracts you while riding. Keep control of the scooter at all times.
- Ride at speeds appropriate for conditions; respect speed limiters and geofences. Do not tamper with locks, batteries, GPS, or safety systems.
- Do not ride on sidewalks or pedestrian-only areas where prohibited, against traffic, on highways or restricted roads, or outside the service zone.
- Inspect the scooter before riding. Report damage or faults in the App and do not ride an unsafe vehicle.
Parking and ending a trip
End trips only in allowed parking zones. Do not block doorways, ramps, bus stops, crossings, or private property. Improper parking, abandonment, or loss may result in fees, recovery costs, and account suspension.
No commercial okada / passenger hire
You may not use Fleet scooters or motorcycles to carry paying passengers or operate as a commercial motorcycle taxi (okada) unless Fleet has expressly authorised a commercial product and you hold every licence, union registration, medical clearance, and district assembly permit required under the Road Traffic Amendment Act, 2025 and related NRSA/DVLA rules. Standard consumer rentals are for private use only.
Car and Coach Rentals
Rental period and condition
The rental begins when you take possession (or when the App records unlock / handover) and ends when the vehicle is returned on time, in substantially the same condition, with keys, documents, and accessories, to the agreed location. Late returns may incur additional charges. Vehicles remain Fleet's (or our partner's) property; you receive a limited right to use them.
Permitted and prohibited use
- Use only for lawful personal or expressly authorised business travel within Ghana, unless cross-border travel is approved in writing.
- Only drivers listed and verified on the booking may drive. Adding a driver requires prior approval and licence checks.
- Prohibited: racing; off-roading (unless designated); towing; overloading; hazardous materials; subleasing; paid passenger transport without Fleet authorisation; impaired driving; or any use that voids insurance.
- Restrain children in accordance with Ghanaian law, including child restraint and seating rules under the amended Road Traffic Act.
- Comply with speed limits, seat-belt rules, and all traffic regulations under Act 683, L.I. 2180, and local by-laws.
Fuel, charging, and mileage
Return fuel or charge level as stated in your confirmation (commonly same-to-same). Mileage packages, overtime, and cross-border fees apply as disclosed at booking.
Insurance, Accidents, and Liability for Damage
Compulsory cover
Fleet (or the vehicle owner partner) maintains motor insurance meeting compulsory third-party requirements of the Motor Vehicles (Third-Party Insurance) Act, 1958, and National Insurance Commission rules, for vehicles legally required to carry such cover. Third-party insurance protects others; it does not automatically cover all damage to the rented vehicle, your injury, or your belongings.
Your financial responsibility
- You are responsible for loss of or damage to the vehicle, accessories, keys, and equipment during the rental, up to amounts in the damage / excess policy, except where caused by Fleet's proven negligence or a defect you timely reported.
- You are responsible for traffic fines, tolls, clamping, towing, and penalties during the rental, plus disclosed administration fees.
- Optional damage waivers or reduced-excess products, if offered, have their own terms and exclusions (impairment, unauthorised drivers, off-road use, failure to report an accident, and similar).
Accidents and incidents
If an accident, injury, theft, or serious malfunction occurs: ensure safety and call emergency services where needed; notify the police where required; notify Fleet as soon as practicable; do not admit liability beyond factual statements required by authorities; cooperate with insurers and investigators; and do not authorise major repairs without Fleet's consent except to prevent further harm.
Fees, Deposits, and Payments
Prices, deposits, unlock fees, rates, taxes, and surcharges are shown before you confirm. By confirming, you authorise Fleet and its payment processors to charge your payment method for the rental, extensions, fines passed through, damage assessments, recovery costs, and other amounts owed. Deposits may be pre-authorised and released after return inspection per the disclosed timeline.
Cancellations and refunds follow the checkout policy. We may refuse or cancel for safety, fraud, unavailability, or force majeure and refund amounts for services not provided, except where cancellation results from your breach.
User Conduct and Compliance with Ghanaian Law
You agree that you will:
- Obey the Road Traffic Act, 2004 (Act 683), Road Traffic Regulations, 2012 (L.I. 2180), amendments including the Road Traffic Amendment Act, 2025, DVLA and NRSA directives, and local assembly by-laws.
- Not use the Services for illegal activity, harassment, fraud, or to interfere with other users or Fleet systems.
- Not reverse engineer, scrape, or misuse the App except as allowed by mandatory law.
- Treat vehicles, parking areas, and other users with reasonable care.
Package Delivery and Other Marketplace Features
When you book package delivery or similar features, send only lawful goods, describe contents and value accurately, and do not tender prohibited items (illegal drugs, weapons, hazardous materials, or undeclared high-value items beyond stated limits). Fleet may refuse or abandon unsafe or illegal consignments and report them when required.
Driver and Partner Programmes
Applying to drive or deliver with Fleet is subject to separate partner terms, background checks, vehicle standards, and licensing. Commercial motorcycle passenger services, where offered, require DVLA commercial licensing, minimum age and training rules, union membership where mandated, medical fitness, and any district assembly operating permit then in force.
Disclaimers
The Services and vehicles are provided on an "as available" basis. To the fullest extent permitted by Ghanaian law, Fleet does not warrant uninterrupted, error-free, or fully secure Service, or that every vehicle will be available at a given time or location. Riding and driving involve inherent risks that you accept when you operate a vehicle.
Nothing in these Terms excludes liability that cannot be excluded under Ghanaian law, including death or personal injury caused by negligence where such exclusion is prohibited, or fraud or fraudulent misrepresentation.
Limitation of Liability
To the maximum extent permitted by law, Fleet's total liability arising out of or relating to the Services or these Terms shall not exceed the greater of (a) the amounts you paid to Fleet for the specific rental or transaction giving rise to the claim in the three (3) months before the claim, or (b) GH¢500. Fleet is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data, goodwill, or business opportunity, even if advised of the possibility, except where such limitation is unenforceable under Ghanaian law.
Indemnity
You agree to indemnify and hold harmless Fleet, its directors, employees, agents, and vehicle-owner partners from claims, losses, fines, and expenses (including reasonable legal fees) arising from your breach of these Terms, your operation of a vehicle, your violation of law, or injury or damage you cause, except to the extent caused by Fleet's wilful misconduct or negligence as finally determined.
Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access, cancel trips, or refuse future rentals if you breach these Terms, create safety or fraud risk, fail verification, or if required by law. Provisions that should survive (fees owed, indemnities, limitations, governing law) survive termination.
Privacy and Data Protection
We process personal data under our Privacy Policy and the Data Protection Act, 2012 (Act 843), including location data needed for rentals, parking verification, safety, and insurance claims. By using the Services you acknowledge that location and trip data may be collected while a rental is active.
Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the website or App with an updated date. Continued use after the effective date constitutes acceptance, except where mandatory law requires additional consent.
Governing Law and Disputes
These Terms are governed by the laws of the Republic of Ghana. Courts of competent jurisdiction in Ghana (including the High Court, Commercial Division, sitting in Accra, where applicable) have jurisdiction, without prejudice to mandatory consumer protections or ADR under the Alternative Dispute Resolution Act, 2010 (Act 798). Before filing a claim, contact us and attempt good-faith resolution within thirty (30) days.
General
If any provision is held unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in a reorganisation or sale. These Terms, the Privacy Policy, and any booking-specific terms you accept are the entire agreement on the Services.
These Terms allocate operational risk and are not a substitute for independent legal advice. Where a mandatory DVLA, NRSA, NIC, or assembly rule conflicts with these Terms, the mandatory rule prevails.
